1. Company Information
Excel Edge Learning Inc. (“Excel Edge,” “we,” “us,” or “our”) is a Canadian corporation operating an online tutoring platform at https://exceltutors.ca (the “Platform”).
2. Acceptance of Terms
By accessing the Platform or registering a child or ward (“Student”), you confirm that you are the parent or legal guardian, have authority to consent on the Student’s behalf, and agree to these Terms & Conditions (“Terms”).
If you do not agree, you must not use the Platform.
3. Governing Law
These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada, without regard to conflict-of-law rules.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta.
4. Eligibility & Parental Responsibility
- Accounts may only be created by parents or legal guardians aged 18 or older.
- You are responsible for:
- All activity conducted under your account
- The Student’s conduct during sessions
- Providing a suitable learning environment
Excel Edge does not replace parental supervision.
5. Nature of Services
Excel Edge provides access to:
- Online tutoring sessions
- Virtual classroom and learning tools
- Progress tracking and reporting
We do not guarantee specific academic outcomes, grades, or performance improvements.
6. Tutors – Independent Contractors
- Tutors are independent contractors, not employees, agents, or partners of Excel Edge.
- Tutors are responsible for their own instructional methods and conduct.
- Excel Edge performs reasonable vetting but does not guarantee tutor behavior, qualifications, or outcomes.
7. Platform Use & Conduct
Users of the Platform, including parents or guardians, Students, and tutors, must:
- Behave respectfully, professionally, and in a manner appropriate for a child-focused educational environment
- Use the Platform solely for lawful educational and tutoring purposes
- Refrain from abusive, discriminatory, harassing, threatening, or otherwise inappropriate conduct
- Comply with all applicable laws, these Terms, and the Company’s Code of Conduct & Safeguarding Policy
Session Recording
By accessing or using the Platform:
- Parents or legal guardians consent, on behalf of their child or ward, to the recording of tutoring sessionsconducted through the Platform.
- Tutors consent to the recording of sessions in which they participate.
- Users acknowledge that session recording may be used for administrative purposes, including quality assurance, tutor performance review, service improvement, training, dispute resolution, and promotional or marketing activities, in accordance with the Company’s Privacy Policy.
Enforcement
Excel Edge Learning Inc. reserves the right, in its sole discretion, to monitor Platform activity and to suspend or terminate access where conduct violates these Terms, the Code of Conduct, or poses a safety, legal, or operational concern.
8. Scheduling, Attendance & Cancellations
- Sessions are scheduled in advance.
- Missed or late-cancelled sessions may be forfeited in accordance with posted policies.
- Cancellation rules will be disclosed at booking.
9. Fees & Payments
- Fees are disclosed prior to purchase.
- Payments are processed through secure third-party providers.
- Refunds are subject to posted policies and applicable Alberta consumer protection laws.
10. Intellectual Property
All Platform content, including software, materials, and branding, is owned by Excel Edge or its licensors.
Unauthorized reproduction or distribution is prohibited.
11. Technology Disclaimer
The Platform is provided “as is” and “as available.”
Excel Edge does not guarantee uninterrupted or error-free access and is not responsible for outages caused by third-party services or internet failures.
12. Limitation of Liability
To the maximum extent permitted by applicable Alberta law:
- Excel Edge Learning Inc. shall not be liable for any indirect, incidental, special, or consequential damages, including loss of academic opportunity, emotional distress, or loss of anticipated outcomes.
- Excel Edge Learning Inc. is not responsible for the acts or omissions of independent tutors, who are not employees or agents of the Company.
Liability Cap
To the extent that Excel Edge Learning Inc. is found liable notwithstanding the foregoing limitations, the total aggregate liability of Excel Edge Learning Inc. arising out of or related to the Platform or services shall not exceed the total fees paid by the parent or legal guardian to Excel Edge Learning Inc. in the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits or excludes liability where such limitation is not permitted under applicable law, including liability for gross negligence or willful misconduct where required by law.
13. Indemnification
You agree to indemnify and hold harmless Excel Edge from claims arising from:
- Breach of these Terms
- Student misconduct
- Misuse of the Platform
14. Termination
Excel Edge may suspend or terminate access if these Terms are violated or if continued use poses legal, safety, or operational concerns.
15. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.

1. Legal Compliance
This Privacy Policy complies with:

2. Information We Collect
Parents / Guardians
- Name, email, phone number
- Billing and payment details
Students (Minors)
- First name or alias
- Grade level and academic information
- Attendance and participation data
Automatically

- Device and usage analytics
- Cookies for functionality
3. Purpose of Collection
We collect personal information to:
- Deliver tutoring services
- Communicate with parents
- Track learning progress
- Meet legal and accounting obligations
4. Consent
Parents provide consent on behalf of Students.
Consent may be withdrawn subject to legal and contractual limitations.
5. Data Sharing
We may share information with:
- Assigned tutors (minimum necessary)
- Payment processors
- Secure service providers
We do not sell personal information.
6. Data Safeguards
We use reasonable administrative, technical, and physical safeguards appropriate under Alberta PIPA.
7. Retention
Information is retained only as long as necessary for service delivery, legal compliance, and dispute resolution.
8. Access & Correction
You may request access to or correction of personal information by contacting our Privacy Officer.
9. Use of Information, Session Recording & Consent
Excel Edge Learning Inc. may record online tutoring sessions conducted on the Platform for the following purposes:
- Quality assurance and internal training
- Tutor performance review and service improvement
- Platform administration and dispute resolution
- Creation of promotional or marketing materials, where permitted
By using the Platform:
- Parents or legal guardiansprovide consent on behalf of their child or ward for the recording of tutoring sessions.
- Tutorsconsent to the recording of sessions in which they participate.
- Parents, guardians, Students, and tutorsacknowledge that session recording is a standard feature of the Platform.
Use of Recordings
- Recordings used for administrative, quality, or training purposeswill remain confidential and accessible only to authorized personnel.
- Recordings used for promotional or marketing purposeswill:
- Not disclose a Student’s full name or identifying personal information, and
- Be anonymized or edited where reasonably possible, unless additional express consent is obtainedfrom the parent or guardian.
Storage & Retention
- Session recordings are stored securely.
- Recordings are retained only for as long as reasonably necessary to fulfill the stated purposes or to meet legal obligations.
Parents or guardians may contact Excel Edge Learning Inc. to inquire about recordings or request deletion, subject to legal and operational requirements.
